Terms of Service

1. Who We Are & Acceptance

These Terms of Service ("Terms") govern your use of Slowary ("the App"), a language-learning application operated by Adam Kalinowski, conducting business as Slowary, Aleja Solidarności 13, 15-751 Białystok.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

Our Privacy Policy describes how we collect and use your data.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent that you meet this age requirement and that you have the legal capacity to enter into a binding agreement.

3. Account

You are responsible for maintaining the security of your account credentials. You must not share your account with others.

We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in abuse, fraud, or illegal activity.

4. License

We grant you a personal, non-transferable, non-exclusive license to use the App for your personal, non-commercial use.

You may not: reverse engineer, decompile, or disassemble the App; scrape, harvest, or extract data; resell or redistribute the App or its content; or use it for any unlawful purpose.

5. Subscriptions & Billing

Subscriptions are purchased through Apple In-App Purchase ("IAP"). Prices may vary by region and include applicable taxes. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the renewal date. Payment is charged to your Apple ID account at confirmation of purchase and at each renewal.

To cancel before renewal: iOS Settings → Apple ID → Subscriptions → select Slowary → Cancel Subscription. Trial periods, if offered, convert to paid subscriptions unless canceled before the trial ends.

Restore purchases: use the "Restore Purchases" option in the App to recover subscriptions bought on another device with the same Apple ID.

Billing and refunds are controlled by Apple. We do not process refunds directly; contact Apple for refund requests. Refunds are subject to Apple's App Store policies.

Apple relationship: Apple is not a party to these Terms. Apple has no obligation to provide maintenance or support for the App. Any claims relating to the App are directed to us, not Apple.

6. Content & Intellectual Property

The App software, UI, and design are our property. Story content and learning materials are owned by us or used under license (including public domain or third-party licensed texts). Where required, we provide attribution.

7. User Content & Acceptable Use

If you submit feedback, notes, or other content through the App, you grant us a non-exclusive, worldwide, royalty-free license to host, process, and use it for operating and improving the service. You retain ownership of your content. You must not submit illegal, offensive, or infringing content.

You agree not to: cheat, abuse, interfere with the App's operation, use automated access (bots, scrapers), or attempt to gain unauthorized access to our systems or other users' accounts.

8. Availability & Changes

We may change, suspend, or discontinue features of the App at any time. We do not guarantee uninterrupted or error-free operation.

9. Disclaimer

The App is an educational tool. We do not guarantee any specific learning outcomes. The App is provided "as is" without warranties of any kind, express or implied.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability shall not exceed the fees you have paid to us in the twelve months preceding the claim. We exclude liability for indirect, incidental, consequential, or punitive damages where permitted by law.

If you are an EU consumer, nothing in these Terms limits your mandatory statutory rights (including rights to remedies under consumer protection law). Our liability limits apply only to the extent permitted by applicable law.

11. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms.

12. Termination

We may terminate or suspend your access at any time. You may stop using the App at any time. Upon termination, your right to use the App ceases; you lose access to premium features and any content stored on our servers. Content stored locally on your device may remain until you uninstall the App.

Data retention and deletion after termination are described in our Privacy Policy. You can request account deletion in-app via Settings → Delete Account, or by contacting us.

13. Governing Law & Contact

These Terms are governed by the laws of Poland and the European Union. Any disputes shall be resolved in the courts of Poland.

EU consumers may use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes in-app or by email where appropriate. We encourage you to review these Terms periodically.
